Malpractice Insurance

Malpractice insurance protects clinicians in the event of a legal claim related to their clinical work. As 1099 contractors, you’re both legally and contractually required to carry your own malpractice coverage.

You can choose any provider you like, many well-known insurance companies like State Farm offer malpractice insurance. Just make sure it covers between $1–3 million, and you’re good to go. I personally use the American Professional Agency because it’s designed specifically for mental health counselors. It offers the most comprehensive coverage at the best price I’ve found. I work directly with a representative there, and I’ve included all the details and forms below to make it super simple and easy if you’d like to go that route.

Fill it out to the best of your ability—some of the questions can be a little confusing, but it’s totally doable. Most people choose coverage in the $1–3 million range. That’s what I personally use and what I recommend. This means you’re covered for up to $1 million per claim and up to $3 million total per policy year, which is the standard for mental health professionals​

 

The cost is typically around $160 a year, so it’s not a big expense, but it’s an important one.
